How Do the Respiratory Care Board of California Discipline Proceedings Work?

The Respiratory Care Board protects and serves California consumers by administering and enforcing the Respiratory Care Practice Act and its regulations in the interest of the safe practice of respiratory care.

The Board is charged with investigating complaints, issuing warnings and penalties, and overseeing the administrative prosecution against licensed respiratory care practitioners and unlicensed personnel for violations of the Act.

Once the Board receives a complaint, the Executive Officer or designated staff will review it to determine the appropriate initial action.

Referring the case to another agency with proper authority.
Issuing a citation or fine.
Forwarding the complaint to the Office of Attorney General for filing of a formal accusation.
